The Department of the Army, Army Contracting Command - Rock Island (ACC-RI), on behalf of Pine Bluff Arsenal (PBA), intends to negotiate and award a sole source, firm-fixed-price contract to Bayer for the procurement of White Phosphorus. This procurement is being conducted in accordance with FAR Part 12, Acquisition of Commercial Products and Commercial Services. The statutory authority permitting this sole source acquisition is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (and FAR 13.501(a) for commercial products).
