Special Notice for Market Research for Use of a Project Labor Agreement on Alaska District Corps of Engineers Project, JBE079 Alaska Air National Guard Supply Complex, JBER AK Classification Code:  Y1AZ – Construction of Other Administrative Facilities and Services Buildings NAICS Code:  236220 – Commercial and Institutional Building Construction Synopsis:  This is a request for information.  This is not a Request for Proposals (RFP), Request for Quote (RFQ), or an Invitation for Bid (IFB) and it shall not be construed as an obligation on the part of the Government.  There will be no solicitation, specification, or drawings available at this time. This is not an announcement of the availability of a solicitation nor is it a means of generating a plan holder’s list. The U.S. Army Corps of Engineers, Alaska District, is conducting this market research to identify businesses which have the capability to perform the following work: The selected contractor is required to have sufficient staff, flexibility, and capability to be available on an as-needed basis.  Interested firms must be able to provide all management, tools, supplies, parts, materials, equipment, transportation, and trained labor necessary to construct a 60,100 SQFT high-bay Supply Complex for the Alaska Air National Guard (ANG) that supports training, administrative, and logistical requirements for the AKARNG. This facility includes the following items that are integral to the facility; Backup/Emergency Generator, Organizational Vehicle Parking (Paved), Controlled Waste Facility, and Flammable Materials Facility. Comprehensive interior design services are requested. This facility will be designed to meet Industry Standards as well as all local, State, and Federal building codes and as per 42 U.S.C. 4154. Construction will include all utility services, information systems, fire detection and alarm systems, roads, walks, curbs, gutters, storm drainage, parking areas, and site improvements. Facilities will be designed to a minimum life of 50 years in accordance DoDs UFC 1-200-02 including energy efficiencies, building envelope and integrated building systems performance as per ASA (IE&E) Sustainable Design and Development Policy Update 2017. The underlying land of the planned location is DoD owned and licensed to the State of Alaska for ARNG use. The estimated dollar magnitude of this project is anticipated between $25,000,000 and $100,000,000. All Offerors must be registered in the System for Award Management (SAM) (https://www.sam.gov).  Joint ventures must be registered in SAM as the joint venture. An Offeror is required to be registered in SAM when submitting an offer, and shall continue to be registered until time of award. Firms not currently registered in the System for Award Management (SAM) are strongly encouraged to apply for registration. Failure to register in the SAM database will result in ineligibility for award consideration. Additionally, in accordance with DFARS 252.204-7021, Cyber Security Maturity Model Certification (CMMC), offerors must be LEVEL 1 self-certified. The Corps of Engineers, Alaska District is soliciting comments from the construction community from the construction community addressing the use of Project Labor Agreements (PLA) for construction projects (including new work, additions, alterations, and repairs) use of a Project Labor Agreement (PLA).  The particular construction project is FY26 Design Build project JBE079 AK ANG Supply Complex at JBER Alaska.  A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement as described in 29 U.S.C. 158 (f).  Effective January 22, 2024, Final Rule (FAR Case 2022-003), implements Executive Order (E.O.) 14063, Use of PLAs for Federal Construction Projects, which requires the use of PLAs in large-scale (defined as $35 million or more) Federal construction projects within the United States. Contractors and subcontractors working on large-scale construction projects must negotiate or become party to a PLA with one or more labor organizations unless an exception is granted.  This requirement applies to new solicitations, including task or delivery orders, issued on or after January 22, 2024. The Government is requesting information to determine if the use of project labor agreements will (1) advance the Federal Government's interest in achieving economy and efficiency in Federal procurement; (2) promote adequate competition at a fair and reasonable price; and (3) be consistent with statutes, regulations, laws etc. The Government is seeking information from both unionized and non-unionized contractors, as well as contractors familiar with the federal marketplace as well as new entrants, that may be interested in participating in competition for this procurement.  Reference is made to: FAR 22.5 Use of Project Labor Agreements for
