What Section 45V Can and Cannot Do

Section 45V rewards qualified clean-hydrogen production. It does not fund a feasibility study, reimburse a grant budget, or guarantee that a plant's output has a buyer. The IRS 2025 Form 7210 instructions state that Public Law 119-21 eliminates the credit for facilities beginning construction after 2027. The instructions define a qualified facility as one that begins construction before January 1, 2028. They also describe the Physical Work Test and Five Percent Safe Harbor for establishing the start of construction. Project teams should obtain tax and engineering advice before relying on either route. For hydrogen produced in 2025, the instructions list inflation-adjusted base amounts from $0.127 to $0.637 per kilogram depending on lifecycle greenhouse-gas emissions. The amount is multiplied by five when the facility satisfies the applicable prevailing-wage and apprenticeship rules or the specified earlier-construction rule. Do not copy those 2025 dollar values into a 2026 model without checking the latest IRS guidance. The production and sale or use must be verified by an unrelated party.
